DWI arrest while CHL is an automatic UCW by gigag04 » Wed Jun 01, 2011 11:56 am Not that we encountered this exact scenario at work or anything DWI is a class B misdemeanor If a CHL holder has a gun IN their vehicle or on their person (carrying under MPA or CHL - you pick), they get an automatic class A misdemeanor UCW charge

My rationale (or lack thereof) was that failing to conceal would be a charge of Failure to Conceal, whereas carrying where one cannot carry would be the UCW charge course, I could be wrong, it's happened before!

UCW makes no mention of the loaded condition of the weapon, or whether it is cased or not That means a gun in unloaded condition or cased would still be chargeble under UCW, if it meets the other elements

In this case, since the LEO is also a qualified LTC instructor (who should know better), I think you would have a strong case in civil court if you were in fact arrested for UCW when you received no notice other than a non-compliant 30 06 type sign

In 1994 I was arrested and charged with a Class C Misdemeanor UCW It was for a knife I received deferred adjudication and that was the end of it Now I'd like to get my CHL but not sure if that will stop it Anyone know? Re: carrying on a boat by KRM45 » Fri May 01, 2009 1:40 am I doubt you would find a Texas LEO that will enforce a Federal Law that relates to carrying a firearm on Federal property If you don't have a CHL they may take you in for UCW It's hard enough to be up on all the Texas laws, I doubt most LEO's even try to study up on Federal ones
